PMF - MATCHPOINT STUDIO END USER LICENCE AGREEMENT Version 1.0.5 - September 2026 IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE. By installing or using PMF - MatchPoint Studio (the "Software"), you agree to this End User Licence Agreement (the "Agreement"). If you do not agree, do not install or use the Software. 1. LICENCE GRANT The Software is provided free of charge. Subject to this Agreement, the Publisher grants you a limited, non-exclusive, revocable, non-transferable licence to install and use the Software solely for personal and non-commercial purposes. 3. PERMITTED PERSONAL USE You may use the Software to examine and document items in your own collection, create reports for your personal records, and provide a report in connection with the occasional private transfer or sale of an item from your own collection, provided that the report is not sold as a separate service and is not presented as having been created, reviewed or endorsed by PhotoMatchForensics.com. 4. PROHIBITED USE You may not: - use the Software to provide paid photomatching, authentication, appraisal, certification, consulting or similar services; - sell, rent, sublicense, commercially distribute or commercially exploit the Software; - remove, conceal or alter the Software branding, the "Powered by PhotoMatchForensics.com" notice, Document IDs, report disclaimers or legal notices; - represent that PhotoMatchForensics.com or the Publisher examined, authenticated, certified, appraised or endorsed an item or a user-generated report; - use the Software or its reports for unlawful, misleading, fraudulent or rights-infringing purposes; - redistribute modified versions of the Software without the Publisher's prior written permission; or - reverse engineer the Software except to the limited extent that applicable law expressly permits this despite this restriction. 5. USER-GENERATED REPORTS The Software is an image-comparison and documentation tool. It does not independently examine, authenticate, certify or appraise memorabilia. All images, sources, annotations, Match Points, Mismatch Points, Observations, Unresolved Points, descriptions, conclusions and reports are selected or created by the user. The user is solely responsible for checking the accuracy, completeness, legality and evidential basis of all entered information and conclusions before exporting, sharing, publishing or relying on a report. A report generated by the Software is not a certificate or opinion issued by PhotoMatchForensics.com. 6. THIRD-PARTY IMAGES AND RIGHTS You are responsible for ensuring that you have all permissions required to import, reproduce, annotate and share photographs, logos, personal information and other material. This Agreement does not grant any rights in third-party content. 7. LOCAL STORAGE AND BACKUPS The Software stores case data and imported image copies locally on the user's computer. You are responsible for maintaining appropriate backups of the Software's data folder and the original source material. Uninstalling or updating the Software is not a substitute for a backup. 8. AVAILABILITY AND WARRANTY The Software is provided free of charge and on an "as available" basis. To the extent permitted by applicable law, no guarantee is given that it will be uninterrupted, error-free, compatible with every system or suitable for a particular purpose. Mandatory statutory rights remain unaffected. 9. LIMITATION OF LIABILITY The Publisher remains liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability cannot legally be excluded or limited. In cases of slight negligence, the Publisher is liable only for breach of an essential contractual obligation whose fulfilment is necessary for proper performance of this Agreement and on whose fulfilment the user may ordinarily rely. In such cases, liability is limited to damage that was typical and reasonably foreseeable when the Software was supplied. Mandatory liability under applicable law remains unaffected. The user remains responsible for reviewing reports, protecting original evidence and maintaining backups. 10. INTELLECTUAL PROPERTY AND BRANDING The Software, its original source code, visual identity, PMF - MatchPoint Studio name, logos and report design remain protected by applicable intellectual-property laws. No ownership rights are transferred under this Agreement. 11. TERMINATION This licence ends automatically if you materially breach this Agreement. Upon termination, you must stop using and remove the Software. Lawfully created personal case files and reports remain under your responsibility. 12. CHANGES AND SEVERABILITY Future Software versions may be supplied under updated terms shown before installation. If any provision of this Agreement is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law. 13. APPLICABLE LAW This Agreement is governed by the laws of the Federal Republic of Germany, without depriving consumers of mandatory protections available under the law of their habitual residence. Mandatory rules on jurisdiction remain unaffected.
